By using this Website, you and the Funding Corporation agree to submit to the personal and exclusive jurisdiction and venue of the state court located in Hudson County, New Jersey and the federal court located in New Jersey and you waive any jurisdictional, venue or inconvenient forum objections to such courts. THE FUNDING CORPORATION OPERATES THIS WEBSITE FROM ITS OFFICES IN THE STATE OF NEW JERSEY OF THE UNITED STATES OF AMERICA. No waiver by the Funding Corporation of any right under or provision of these Terms and Conditions will be deemed to be either a waiver of any other such right or provision or a waiver of that same right or provision at any other time. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions shall remain in full force and effect. You agree that regardless of any statute, regulation, or law to the contrary, any claim or cause of action arising out of or related to use of this Website or the Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.
